What Is the Rescission Period?

If a loan includes a right to rescind, the borrower has 3 (three) business days to cancel. The clock starts on the next business day after the last of these occurs: (1) the signing (consummation), (2) the borrower receives the material disclosures, or (3) the borrower receives the Notice of Right to Cancel (NRTC). This three-day window is the rescission period.

How the Rescission Date Is Calculated

For rescission purposes, a business day is every calendar day except Sundays and the legal public holidays listed in 5 U.S.C. § 6103(a). Saturdays count. Those holidays are:

  1. New Year’s Day — January 1
  2. Birthday of Martin Luther King, Jr. — third Monday in January
  3. Washington’s Birthday (often called Presidents Day) — third Monday in February
  4. Memorial Day — last Monday in May
  5. Juneteenth National Independence Day — June 19
  6. Independence Day — July 4
  7. Labor Day — first Monday in September
  8. Columbus Day — second Monday in October
  9. Veterans Day — November 11
  10. Thanksgiving Day — fourth Thursday in November
  11. Christmas Day — December 25

Observed-date rule:

  1. If a fixed-date holiday (e.g., July 4, Nov 11, Dec 25, Jan 1, Jun 19) falls on Sunday, the following Monday is also treated as a holiday (excluded).
  2. If it falls on Saturday, the preceding Friday still counts as a business day for rescission; only the Saturday holiday is excluded.

How to Rescind

To cancel, the borrower must give notice by midnight of the third business day. The notice can be mailed, delivered, or sent by other permitted means. If mailed, the notice is effective when placed in the mail, even if the postmark reflects a later processing date. Example: If the rescission period ends at midnight on Saturday and the borrower mails the notice at 10:00 p.m. on Saturday, the loan is canceled even though the envelope may not be postmarked until Monday.
